Terms of Service

These Terms are between you and Green Package Pro LLC, a Arizonalimited liability company, which operates EyesInAI (“EyesInAI”, “we”, “us”). By using the website or the services, you agree to these Terms. If you are agreeing on behalf of a company, you confirm you have authority to bind it, and “you” means that company.

EyesInAI publishes independent benchmark data about AI models, and provides paid services to client businesses: hosted assistants, model routing, and related connectors and reporting. The public benchmark content is free to read.

Our published measurements are observations of how models performed on our tests, at a point in time, under conditions we describe. Models, prices, and provider behaviour change frequently, and a result that was accurate when measured may not hold later.

The benchmark content is information, not advice. Decisions you make about which model or vendor to use are yours. We publish our method so you can check it; we do not warrant that a result will reproduce in your environment.

You are responsible for activity under your account and for keeping your sign-in secure. Tell us promptly at [email protected] if you believe it has been compromised. We may suspend an account where we reasonably believe it is being used in breach of these Terms or the Acceptable Use Policy.

You keep ownership of everything you send to the service — your prompts, your documents, your business records, and your end users' conversations. You grant us only the licence needed to operate the service for you: to process, transmit, store, and display that content for the purpose of providing and supporting it, and to produce the anonymous measurements described in the Data Retention Policy.

We do not use your content to train AI models. We do not sell it. Where your content includes personal data about your own customers or staff, the Data Processing Addendum applies and forms part of these Terms.

You are responsible for having the right to send us the content you send, and for what you choose to expose to an assistant you configure.

The service uses AI models. AI models produce wrong answers, including answers that are wrong while sounding confident, and this is a property of the technology rather than a defect we can fully eliminate. We work to reduce it — that is much of what the routing and grounding layers do — but we cannot warrant that output will be accurate, complete, or fit for a particular purpose.

Do not use the service as the sole basis for a decision with legal, financial, medical, safety, or employment consequences without a human reviewing it. Where you deploy an assistant to your own users, you are responsible for what it tells them.

Paid plans are billed as described in the Payment & Card Terms. Free access to public benchmark content does not require payment and may be changed or discontinued.

The service depends on AI model providers and infrastructure vendors listed in Subprocessors. Their availability, pricing, and model lifecycles are outside our control. We may substitute a provider or model — that is a core function of a routing service — and will not degrade a documented capability of your plan without notice.

We aim for continuous availability but do not guarantee uninterrupted service. We may perform maintenance, and may modify or discontinue features. For material reductions affecting a paid plan, we will give reasonable notice.

We own the service, the website, our benchmark methodology, and our software. You may read, quote, and cite published benchmark results with attribution to EyesInAI. You may not scrape the site systematically, resell our data as your own product, or present our measurements as yours.

You may stop using the service at any time and cancel a paid plan as described in the Payment Terms. We may terminate or suspend for material breach, non-payment, or use that creates legal or security risk; where practical we will give notice and an opportunity to cure.

On termination we stop processing your content. Conversation content already held is erased on the normal retention schedule, or sooner on request. You may ask for an export of your configuration and data before termination takes effect.

Except as expressly stated, the service is provided “as is” and we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. Some jurisdictions do not allow certain exclusions, in which case they apply to you only to the extent permitted.

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total aggregate liability arising out of or relating to these Terms will not exceed the amounts you paid us for the service in the twelve months before the event giving rise to the claim.

These limits do not apply to a party's liability for fraud, willful misconduct, or anything else that cannot be limited under applicable law.

You will defend and indemnify us against third-party claims arising from your content, your use of the service in breach of these Terms or the Acceptable Use Policy, or your deployment of an assistant to your own users. We will defend and indemnify you against third-party claims that the service as provided by us infringes their intellectual property rights.

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law rules, and the parties submit to the exclusive jurisdiction of the state and federal courts located in that state.

We may update these Terms. For material changes affecting a paid plan we will give notice to the account contact before they take effect. Continuing to use the service after that constitutes acceptance.
